    Please can someone advise if someone who is 19yrs when they started their apprenticeship and was being paid the National Apprenticehship wage for the first 12 months of their programme, who then goes on an ABL due to Covid reasons, but is now resuming learning 6 months later – does their employer have to now pay them NMW for their age or can they continue to pay them the Apprenticeship wage until they have been in active learning for the 12 months ? MTIA

    Apprentices are entitled to the apprentice rate if they’re either:

    aged under 19
    aged 19 or over and in the first year of their apprenticeship

    The first year would not include the BIL, they have to be on programme for 12 months before they attract the NMW for their age.
