    Hello.

    Does anyone know what happens if a learner is enrolled on L2 Functional Skills but after many attempts simply cannot achieve them? Is it possible for us to downgrade the aims to L1 Functional Skills?

    If we can downgrade them, how do we record this on the ILR?

    Why did you enrol them on L2 in the first place? Did their initial assessment result show that they were at L1?

    If so, I would have said that downgrading them to L1 would not be fundable? Martin – thoughts?

    What funding model is this FM36 apprenticeships or FM35 AEB?

    FM36 Apprenticeships

    IAs and diagnostics indicated they would be fine for L2 and the learner was keen to do L2.

    So – thinking about this from an auditors point of view, the initial assessments have come out at L1 minimum, yes? If they have, then L1 FS would not be fundable.

    Based on what you have said about IA, guessing that are working at Level 1 and so paragraph 137.2 applies https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/857045/1920_Provider_Rules_Version_2.0_FINAL.pdf

    You can transfer them to the level 1, but cannot claim funding for the level 1.

    On the transferred L1 aim use Funding adjustment for prior learning of 0 (The proportion of this learning aim still to be delivered) as all funding is claimed on the L2 then record the achievement on the L1.

    I d record as FM99 and not use the prior learning adjustment.

    The aim isn’t eligible for funding so has nothing to do with prior learning. Even if the prior learning adjustment is recorded as 0 does it still award the completion payment? (which you wouldn’t be eligible to claim).

    I’d not even bother with the transfer. Record the Lv2 as completed not achieved and then enrol them as non funded to the level 1.

    Thanks Jesscar. If the the new L1 aims are unfunded, is it necessary to record them on the ILR?

    Sorry just checked – no completion payments for Maths & English, but i d still record them as non funded.

    Non funded should be returned on the ILR if there is at least one episode of learning. If they are only sitting the exam, then we as a provider don’t return them but have them on our MI system so we have an enrolment to attach the result to.
